By way of instant application filed under Section 151 of the CPC, prayer has been made on behalf of the applicant/petitioner for recalling of order dated 11.05.2026, whereby Arbitration Case No. 6 of 2025 came to be dismissed for non-prosecution.
Though, reply to the application is stated to have been filed, but the same is not on record, however, learned counsel representing the non-applicant/respondent fairly states that this Court, taking note of the averments contained in the application may pass appropriate orders.
Having taken note of the averments contained in the application, which is duly supported by an affidavit, this Court finds that on account of miscommunication between the applicant and his lawyer, nobody could put in appearance on 11.05.2026, as a result thereof, this Court had no option, but to dismiss the case for non-prosecution.
For the reasons stated in the application, the same is allowed and order dated 11.05.2026 is recalled, and the
Arbitration Case bearing CARBC No. 06 of 2025 is ordered to be restored to its original number. The application stands disposed of.

Further four weeks’ time, as prayed for, is granted to the petitioners to comply with order dated 04.03.2025, failing which, this Court shall have no option, but to vacate the interim protection granted vide aforesaid order.
