By this petition filed under section 528 of BNS, 2023 the petitioner prays for recalling the order dated 08.08.2025 passed in CRMP.No.1246/2022 which has been dismissed as infructuous. 2 2. Learned counsel for the petitioner submits that when the CRMP.No.1246 of 2022 was taken up for hearing, inadvertently the earlier counsel who was appearing for the petitioner had submitted that the trial has already been concluded on 12.12.2023, therefore, the petition has become infructuous and on such submission, CRMP.No.1246 of 2022 has been dismissed as infructuous. He submits that the copy of the order sheets have been produced which would show that the matter is still pending and looking to the gravity of the case, he prays for recalling of the order dated 08.08.2025. 4. The above submission of the counsel for the petitioner is not objected by the learned State Counsel. 5. Having regard to the submissions made by learned counsel for the parties and for the reasons stated in the restoration application, the order dated 08.08.2025 is recalled and the CRMP.
