Mr. Robiul Islam Mr. Masooqu Rahman …for the petitioner Mr. Mansoor Alam Mr. Sailendra Sekhar Bayerd …..for the State respondents Mr. Omar Faruk Gazi Ms. Susmita Das Ms. Shooni Panda …for the respondent nos. 7-9 & 12 1) Matter is heard in presence of learned advocates representing the petitioner, State respondents and respondent nos. 7 to 9 and 12. 2) Based on the complaint lodged by the petitioner FIR was registered being Saktipur Police Station Case No. 171/24 dated 20th June, 2024. It is alleged that some of the private respondents on being enlarged on bail vide order dated 17th January, 2025 passed by the Hon’ble Division Bench, are threatening the petitioner and police authorities become mute spectators. Prayer is made for issuance of mandamus directing the police authority to provide necessary assistance which would 2 prevent the private respondents from threatening the petitioner. 3) Considering respective submissions made on behalf of the parties, it appears that Hon’ble Division Bench on 17th January, 2025 allowed the bail application being CRAM (DB) 3396 of 2024 on imposing certain conditions including one that some of the private respondents being the petitioners before the Hon’ble Division Bench shall not enter the jurisdiction of Saktipur Police Station except for the purpose of attending the Court proceedings and shall reside within the jurisdiction of Berhampore Police Station. 4) Private respondents who enlarged on bail vide order dated 17th January, 2025 passed by the Hon’ble Division Bench filed an application being CRAN 2 of 2025 in connection with CRM (DB) 3396 of 2024 seeking relaxation of conditions of bail and petitioner filed an application seeking cancellation of bail being CRM (DB) 927 of 2025. Both the applications were heard by a coordinate Bench on the same date, i.e. 27th February, 2026. The coordinate Bench rejected both the applications, one for relaxation of conditions of bail and another for cancellation of bail filed by the respective parties on 27th February, 2026 meaning thereby the conditions which were imposed at the time of granting bail by the Hon’ble Division Bench on 17th January, 2025 remain in force. One of the conditions as stipulated above prevents the private respondents from entering into the jurisdiction of Saktipur Police 3 Station except for the purpose of attending court proceedings. 5) In view of aforesaid scenario, no further order need be passed in the writ petition giving further protection to the petitioner based on her allegation that she is being threatened by the private respondents. In the event conditions imposed by the Hon’ble Division Bench at the time of granting bail on 17th January, 2025 are not adhered to, petitioner shall be at liberty to take appropriate steps in accordance with law. 6) Writ petition stands disposed of. 7) There shall be, however, no order as to costs. 8) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
