The petitioners are apprehending their arrest in connection with Ichak P.S. Case No.26/2026, registered for the offence under Sections 21(b), 22(b), 27(a), 29 of N.D.P.S. Act, pending in the Court of the learned Sessons Judge, Hazaribagh. 3. Learned counsel appearing for the petitioners submits that the petitioners have been falsely implicated in the case. He further submits that the petitioners have nothing to do with the brown sugar, which has been recovered from the possession of Irfan Ansari and Bablu Kumar. On these grounds, he submits that anticipatory bail may kindly be granted to the petitioners. 4. Learned counsel appearing for the State opposed the prayer and submits that Irfan Ansari and Bablu Kumar have disclosed that the said brown sugar was handed over to them by these petitioners. He also submits that the motorcycle which has been recovered from the place of occurrence is in the name of Vikash Kumar, who is petitioner no.2. On these grounds, he ( 2026:JHHC:16873 ) -2- A.B.A. No. 3018 of 2026 submits that the prayer for anticipatory bail may kindly be rejected. 5. In the FIR, it has been stated that these petitioners have handed over brown sugar to Irfan Ansari and Bablu Kumar and that has been disclosed by none other than the said two co-accused persons, namely Irfan Ansari and Bablu Kumar. The motorcycle, which has been recovered from the place of occurrence is said to be of Vikash Kumar, who is petitioner no.2. There are restrictions of granting anticipatory bail under the N.D.P.S. Act. In the attending facts and circumstances of the case, I am not inclined to extend the privilege of anticipatory bail to the petitioners and, as such, their prayer for anticipatory bail is, hereby, rejected. 6.
