The petitioners are apprehending their arrest in connection with Gomia PS Case No.27 of 2026, for offence registered under section 191(2), 191(3), 190, 126(2), 115(2), 118(1), 117(2), 221, 224, 262, 263(a), 324(4), 324(6), 132, 109(1), 352, 351(2) and 61(2) of BNS, 2023 and Section 3 of Prevention of Damage to Public Property Act, 1984, pending in court of learned Judicial Magistrate, First Class, Bermo at Tenughat.

Learned counsel for petitioners submits that the petitioners have been falsely implicated in this case and the allegations are made that two of the accused persons have been apprehended by the Quick Response Team of Forest Department and the petitioners along with the others have been forcibly taken away two persons from their clutch. She next submits that the petitioners were not

present on the spot and only on suspicion, the petitioners have been implicated in this case and in view of that, anticipatory bail may kindly be granted.
4. Learned State counsel opposes prayer and submits that the allegations are there of forcibly taking away two persons by these petitioners and petitioner no.1 is named in the FIR and in view of that anticipatory bail may kindly be rejected.

Considering that the petitioner nos.1 and 2 are ladies and there are general and omnibus allegations against the petitioner nos.1 to 4 and in view of that, I am inclined to grant anticipatory bail to the petitioner nos.1 to 4, namely, Laxmi Devi, Rubi Kumari, Shambhu Prajapati and Subhash Prajapati.

So far as the petitioner nos.5 and 6 are concerned, they are having criminal antecedent of identical nature, and in view of that, I am not inclined to grant anticipatory bail to the petitioner nos.5 and 6, and as such prayer for anticipatory bail with respect to petitioner nos.5 and 6, is, hereby, rejected.
7. Accordingly, petitioner nos.1 to 4, above named, are hereby
directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, the petitioner nos.1 to 4, namely, Laxmi Devi, Rubi Kumari, Shambhu Prajapati and Subhash Prajapati, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Judicial Magistrate, First Class, Bermo at Tenughat, in connection with Gomia PS Case No.27 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
