Order 30/01/2026
1.
Learned counsel for the petitioner-Deepak Swami wants to withdraw the application (IA No.1/2026) seeking interim bail.
2. Hence, the same is dismissed as withdrawn.
3. The petitioners have preferred this bail application under Section 483 of BNSS in FIR No.234/2025 registered at Police Station Khetri, District-Jhunjhunu for offences under Section 3/25(6) of Arms Act and Sections 111(2)(b) and 111(3) of BNS.
4. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.
5.
Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. He further submits that the allegation against the present petitioners is
[2026:RJ-JP:4420] (2 of 2) [CRLMB-1624/2026] limited to the recovery of seven live cartridges and 12 bore gun to which petitioners do not possess any valid licence. He further submits that though there are two criminal cases reported against the petitioner-Rajesh Kumar but in said cases he has been bailed out. Petitioners are behind the bars since 24.12.2025. The trial of the case may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, hence, the bail application of the petitioners may be allowed.
6. Learned Public Prosecutor has vehemently opposed the bail application.
7. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, and without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.
8. Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the petitioners-Mahesh Kumar S/o Bhup Singh, Deepak Swami S/o Gullaram, Rajesh Kumar S/o Maharam and Jitendra Kumar S/o Amar Singh shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/ each to the satisfaction of the learned trial court for their appearance before that Court on all the dates till conclusion of the trial.
