Learned counsel appearing for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It has been further submitted that the applicant is the only member in his family and has prayed for grant of bail. The applicant is in jail since 14.11.2025, and the conclusion of the trial shall take quite long time. Therefore, he prays for grant of bail. 4. On the other hand, learned State counsel opposes the bail application and submits that from the perusal of the case-diary and statement of the victim recorded under Section 183 of BNSS, it transpires that the applicant is involved in the present case and there are 2 victims of the case who are friends and applicant has tried to outrage the modesty one after other, and further when the victims came to resistance, he also assaulted the victims and both of them have received simple injuries but the statement of the victim fully corroborates with the allegations made against the applicant, moreover, there are two criminal antecedents of the applicant which shows that he is a habitual offender. As such, the bail application deserves to be rejected. 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case and also considering the fact that the charge-sheet has been filed in
3 the present case, and from the perusal of the case-diary and statement of the victim recorded under Section 183 of BNSS, it transpires that the applicant is involved in the present case and there are 2 victims of the case who are friends and applicant has tried to outrage the modesty one after other, and further when the victims came to resistance, he also assaulted the victims and both of them have received simple injuries but the statement of the victim fully corroborates with the allegations made against the applicant, moreover, there are two criminal antecedents of the applicant which shows that he is a habitual offender, thus, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7.
