[3311] two thousand and twenty six Petitioners Respondents
2 C.R.P.No.595 of 2026 O R D E R:
This revision petition is filed under Article 227 of the Constitution of India aggrieved by the inaction of the trial Court in disposing of the I.A.No.422 of 2024 in O.S.No.137 of 2024 on the file of the Court of Civil Judge (Junior Division), Tadipatri filed under Order XXXIX, Rules 1 and 2 C.P.C. seeking interim order. 2. As can be seen from the docket proceedings in I.A.No.422 of 2024, the matter has been adjourned from 13.06.2024 to 05.07.2024 for counters of the respondents Nos.1 to 3 and thereafter adjourned from time to time till 28.01.2025, atleast for seven times. Then, the petitioners themselves filed petition in I.A.No.344 of 2025 seeking certain amendments to petition in I.A.No.422 of 2024. I.A.No.344 of 2025 was allowed on 14.05.2025 and thereafter, the matter was adjourned for getting the amendment carried out and filing the neat copy. On 25.06.2025, the trial Court again adjourned the matter for filing counters of the respondents Nos.1 to 3 and has been adjourning the matter for seven times i.e. till 05.03.2026 for the same purpose. 3. A perusal of the above steps indicates that no serious attention is paid for disposal of the petition and undue amount of time was given for filing counters of the respondents. Therefore, this Court is of the view that the trial Court failed to exercise its discretion in a proper way. 4.
In the result, the petition is allowed directing the trial Court to expeditiously dispose of I.A.No.422 of 2024 in O.S.No.137 of 2024 on the file of the Court of Civil Judge (Junior Division), Tadipatri without giving any further time for filing counters, if not filed on the next date of adjournment. 3 C.R.P.No.595 of 2026 There shall be no order as to costs. Pending miscellaneous petitions, if any, shall stand closed. ___________________ B. S. BHANUMATHI, J Dt.24.02.2026 PNV
