Order 28/01/2026
1. The second application for bail filed under Section 483 of BNSS by the applicant-accused Peyush Bhardwaj S/o Ramesh Chand in FIR No. 44/2025 dated 18.02.2025 registered at P.S. Baggar, District -Jhunjhunu, whereby the applicant-accused was charged under Sections 420, 406, 409 and 120-B IPC.
2.
Learned counsel for the applicant submits that the applicant has been falsely implicated in the matter and the investigation against him is complete and he is no more required in investigation. He further submits that there are no chance of fleeing of applicant accused from the jurisdiction of this Hon’ble Court. He also submits that the
[2026:RJ-JP:3995] (2 of 4) [CRLMB-1500/2026] applicant undertakes not to repeat offence and cooperate with investigation/trial, which will take time.
3.
Learned counsel for the petitioner submitted that the first bail application of the present petitioner was dismissed on 13.08.2025 and that the petitioner is still in custody since his arrest in the instant case, and the trial will take its own time. He further submitted that the present petitioner was granted bail in another FIR No. 34/2025 registered at Police Station Sadar, Jhunjhunu. He also referred to the closure report filed in FIR No. 45/2025 dated 18.02.2025, Police Station Bagar, District Jhunjhunu. He further submitted that the present petitioner is not involved in the instant case, as this is not a case of misappropriation, rather it is a case of irregularity. He also referred to the bail order dated 03.12.2025 and submitted that co-accused Ramotar was granted bail by a Coordinate Bench of this Hon’ble Court. 4. Learned Public Prosecutor has vehemently opposed the bail application and submitted that the allegations are grave and serious in nature. 5. Heard learned counsel for the petitioner-accused and learned Public Prosecutor. Perused the material placed on record by both the parties. 6. On basis of complaint lodged by Development Officer Panchayat Samiti, Jhunjhunu on 18.02.2025 about payment of more than ₹90,00,000/- to unauthorized person and non- filing of reply by present applicant-accused, who was working as Village Development Officer, a report is registered and matter is investigated. It also mentioned that
[2026:RJ-JP:3995] (3 of 4) [CRLMB-1500/2026] the payment is made only from joint signatures of Sarpanch and Secretary and both are jointly liable. 7. The material on record indicates that Sarpanch Nanchi Devi was granted bail by a Vacation Bench of this Court on 09.06.2025, whereas the first bail application of Ramotar was allowed by a Coordinate Bench on 03.12.2025. One more FIR No. 34/2025 was registered against the present petitioner at Police Station Sadar, Jhunjhunu, wherein the petitioner was granted bail by a Coordinate Bench on
12.01.2026. One more FIR No. 45/2025 dated 18.02.2025 was registered against the petitioner at Police Station Bagar, District Jhunjhunu, wherein the police have proposed a closure report. 8. The material on record clearly indicates that the present petitioner is a regular employee and is drawing a salary from the State Exchequer, but there are three incidents of irregular payments.
Though, in one case a closure report has been filed after investigation, in two cases the present petitioner was arrested, out of which the petitioner was enlarged on bail in one case. The material on record is sufficient to draw the conclusion that the present petitioner is in the habit of indulging in corrupt practices and malpractices, thereby being involved in misappropriation with dishonest intention. 9. The facts and the material indicate that the alleged offence are of serious nature and role attributed to applicant is prima facie sufficient to consider complicity of applicant in the crime. Therefore, at this juncture, considering the evidence
[2026:RJ-JP:3995] (4 of 4) [CRLMB-1500/2026] collected so far, this is not a fit case to enlarge the applicant accused on bail. 10. Considering the gravity of allegations and overall facts and circumstances of the case, it is appropriate to dismiss the bail application of the applicant accused at this stage. 11. Accordingly, the second application for bail filed under Section 483 of BNSS preferred by Peyush Bhardwaj S/o Ramesh Chand is hereby dismissed. (ASHOK KUMAR JAIN),J CHETNA BEHRANI /6
