ORAL ORDER The petitioners are before this Court calling in question proceedings in C.C.No.3230/2024, for the offences under Sections 498A, 504, 114, 323 read with Section 34 of the IPC. 2. Heard Sri. Santosh R., learned counsel appearing for the petitioners, Sri. Vinay Mahadevaiah, learned HCGP appearing for respondent No.1, Sri. T.P. Vivekananda, learned counsel appearing for respondent No.2 and have perused the material on record. 3. The parties to the lis were also before the Family Court in M.C.No.321/2025 and have settled the dispute amongst themselves before the Family Court by terms of Memorandum of Agreement. The said Memorandum of Agreement reads as follows:
“MEMORANDUM OF AGREEMENT UNDER SECTION 89 OF CPC R/W24 AND 25 OF KARNATAKA CIVIL PROCEDURE (MEDIATION) RULES 2005
The petitioner and the respondent above named jointly submit the memorandum, as under:

The petitioner has filed this petition for dissolution of marriage by decree of divorce. That the matter came to be referred to mediation for amicable settlement. In the course of medication both the parties have resolved their dispute and they agreed for divorce and live separately with the following terms and conditions:
a) That the petitioner and the respondent have agreed that they cannot lead their marital life in future and amicably settled between themselves to annul their marriage. b) That the petitioner has agreed to pay the sum of Rs.1,00,000/- (Rs.One Lakh only) to the respondent towards her permanent alimony. c) That the respondent has given up all her right over the moveables and immoveable properties of the petitioner and any type of claims against him. The respondent shall not claim any maintenance against the petitioner in future. d) That the petitioner and the respondent have agreed that after the dissolution of marriage they will lead their life independently at their wish and will without any restrictions and bindings against each other in future. e) That both the parties have given up all their allegations leveled against each other. f) That the marriage between the petitioner and the respondent be dissolved. Hence, the petition may kindly be disposed off according, to meet the ends of justice. Hence, this memorandum of settlement.”

In the light of the settlement arrived at between the parties quoted supra and offences not being against the State,

I deem it appropriate to accept the Memorandum of Agreement and terminate the proceedings against these petitioners in the subject petition. 5. For the aforesaid reasons, the following:
ORDER i. Criminal Petition is disposed. ii. Proceedings in C.C.No.3230/2024 pending before the II Additional Senior Civil Judge and JMFC Court, Davangere, stand quashed qua these petitioners.
