Petitioner has filed this writ petition seeking following reliefs. “10.1 This Hon’ble Court may kindly be pleased to direct the respondent authority to grant DA, HRA, Increment & EPF to the petitioner along with interest. 10.2 Issue any other order or orders, writ or writs, direction or directions as this Hon’ble Court may deem fit in the facts and circumstances of the case in favour of the petitioner, in the interest of justice.” 2. Learned counsel for petitioner submits that pursuant to the advertisement issued by the respondent-National Institute of Technology, Raipur (NIT Raipur) for appointment on the post of Information Officer, Technical PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA 2 / 3 Assistant, Data Entry Operator and Traineeship, petitioner submitted his application form and was appointed on the post of Data Entry Operator in Sub-DIC Bio informatics with pay-scale of Rs. 4000-100-6000. Petitioner after some time due to some personal reason has submitted his resignation on 01.08.2017 from the post of Data Entry Operator. Petitioner was not paid the DA, HRA, increment and EPF contribution amount. Petitioner made several requests and representation, based upon which the committee under the NIT, Raipur has computed the entitlement of petitioner towards gross arrear payable to petitioner as also the EPF Employer’s contribution vide Annexure P-5. However, till date the said benefit which is calculated in favour of petitioner has not been paid. She also submits that vide Annexure P-5, not only entitlement of petitioner towards gross arrear payable and EPF employer’s contribution was calculated but along with petitioner there are three other similar situated employees. Petitioner submitted representation before Respondent No. 1 on 07.09.2017, further reminder on 09.04.2025 and 14.06.2025 was also submitted, however, till date no decision has been taken. 3. Learned counsel for the respondents submits that petitioner has resigned from the service and therefore he may not be entitled for benefit as claimed in this writ petition. He further submits that as the submission of learned counsel for petitioner based on Annexure P-5 which is computation of entitlement of petitioner and other three employees, as petitioner submitted representation, it will be considered in accordance with law, if not yet decided. 4. On due consideration of the submission of counsel for the parties, considering the nature of grievance raised by the petitioner, in particular considering the document Annexure P-5 which is computation sheet of the gross arrear payable to employees mentioned therein with EPF employer’s contribution and that petitioner has submitted representation before 3 / 3 Respondents No. 1 & 2, till date no decision has been taken, this writ petition is disposed of at this stage, directing Respondents No. 1 & 2 to take decision on the claim of petitioner, in accordance with law, expeditiously, preferably within a further period of 03 months from the date of receipt of order passed by this court. 5.
