[2026:RJ-JP:3592] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 1419/2026 1. Narendra Alias Noliya S/o Deshraj, Aged About 42 Years, R/o Raipur Jatan Police Station Singhana District Jhunjhunu, Rajasthan. (Accused Petitioner At Present Confined In Jail Jhunjhunu). 2. Karmpal S/o Ramavtar, Aged About 32 Years, R/o Raipur Jatan Police Station Singhana District Jhunjhunu, Rajasthan. (Accused Petitioner At Present Confined In Jail Jhunjhunu). ----Petitioners Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Dushyant Singh Naruka For Respondent(s) : Mr. Manvendra Singh Shekhawat, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 27/01/2026 1. The petitioners have preferred this bail application under Section 483 of BNSS in FIR No.328/2025 registered at Police Station Singhana, District-Jhunjhunu for offences under Section 108 of BNS. 2. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. He further submits that a dispute arose among the deceased and the petitioners regarding a mobile phone coupled with allegation or suspicion that the deceased had stolen the mobile phone belonging to petitioner no. 2. There is no material to suggest that the petitioners created any such situation compelling the deceased [2026:RJ-JP:3592] (2 of 2) [CRLMB-1419/2026] to take the extreme step to commit suicide. Rather, it is submitted that the petitioners themselves took the deceased to the police station, following which the deceased committed suicide in which petitioners have no active role or abetment. Co-accused- Dharmendra has been enlarged on bail by this Court on 13.01.2026. Petitioners are behind the bars since 09.12.2025. Charge-sheet has been filed. The trial of the case may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, hence, the bail application of the petitioners may be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application. 5. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, and without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. 6. Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the petitioners-Narendra Alias Noliya S/o Deshraj and Karmpal S/o Ramavtar shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/ each to the satisfaction of the learned trial court for their appearance before that Court on all the dates till conclusion of the trial.
