Heard the parties.
The petitioners of both Bail Applications have been made accused in connection with Govindpur P.S. Case no. 498/2025 instituted under Section 316(2), 316(5), 318(4), 61(2), 3(5) of BNS, 2023. Learned senior counsel and the learned counsels for the petitioners of the Bail Applications submit that the allegation against the petitioners is that the petitioners being the Directors of M/s Vimla Fuels and Metals Limited by cheating took away fire bricks from the informant by making only part payment of the money by two separate transactions. Out of which one transaction was of Rs. 1,05,51,135/- in respect of
which, they have only paid Rs. 50,00,000/- and the another transaction was worth Rs. 1,06,03,130/- in respect of which, they have paid only 24,80,527/-. It is submitted that the allegation against the petitioners is false and the dispute between the parties is basically a commercial dispute relating to under-payment of the price of the goods purchased. It is next submitted that the petitioners have been in jail custody since 30.01.2026, as mentioned in para 26 of this bail applications. It is next submitted by learned counsel for the petitioners that the petitioners are ready and willing to co- operate with the trial of the case and undertake not to annoy or disturb the informant or the other witness of the case in any manner during trial of the case, hence, the petitioners may be admitted to bail.
Learned counsel for the State and learned counsel for the informant opposes the prayer for bail. Considering submissions of learned counsels and the
facts as stated above, I am inclined to release the petitioners on bail. Hence, the court below is directed to release the petitioners on bail on furnishing bail bond of Rs. 5,00,000/- (Rupees Five Lakhs) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Dhanbad in connection with Govindpur P.S. Case no. 498/2025 with the condition that the petitioners will not annoy or disturb the informant or the other witness of the case in any manner during trial of the case and will co-operate with the trial of the case and will furnish mobile phone number and photocopy of the Aadhar Card in the court below with an undertaking that they will not change the mobile phone number during the trial of the case.
