Ms. Sohini Samanta, learned counsel for the petitioner and Mr. Dhirodatta Chaudhuri, learned counsel for the respondent, are present. 3. Learned counsel for the petitioner submits that the petitioner assailed the disciplinary proceeding before the Tribunal in the instant O.A. 350/1472/2025, which was not entertained. However, recently on 23rd January, 2026, the department in the said disciplinary proceeding has passed a final order of punishment against which the 2 petitioner intends to prefer a statutory appeal. Thus this petition may permitted to be withdrawn to avail remedy of preferring statutory appeal. 4. The other side has no objection. 5.
