Learned counsel for the petitioner submits that the petitioner is in custody since 29.09.2025 in connection with Dhurki P.S. Case No.130/2025, equivalent to POCSO Case No.119/2025, registered under Section 65(2), 62, 331(6), 96, 351 (2) and 332 (a) BNS and under Section 8 & 10 of POCSO Act, charges have been framed under Section 62 (2), 331 (6), 96, 351 (3) of BNS and under Section 4, 6 & 18 of POCSO Act, now pending in the court of learned Special Judge, POCSO Court – cum – ASJ – I – cum – FTC (CAW), Garhwa. 3. The victim, who is 7 years old, is alleged to have been raped by the petitioner aged 20 years. 4. The learned counsel for the petitioner submits that there was some dispute, and therefore, the petitioner has been made an accused in the present case. 5. The learned counsel for the opposite party has opposed the prayer for bail and submitted that there is direct and specific allegation against the petitioner and trial is in progress and the victim is yet to be examined. As per the order dated 12.02.2026, 3 witnesses out of 8 witnesses have already been examined. 6. Considering the allegation made against the petitioner, which is serious in nature, this Court is not inclined to enlarge the petitioner on bail. Accordingly, this bail application is rejected. 2026:JHHC:16932 2 7. However, the State is directed to ensure that the remaining witnesses are promptly produced before the court. 8. The State is directed to communicate this order to the Superintendent of Police of the concerned district and also to the Director Prosecution to ensure compliance. 9.
