Following relief has been claimed in this writ petition:- 10.1 That, this Hon'ble Court be pleased to declare that the impugned non-deduction of CPF from the wages of the petitioners are illegal and unconstitutional. 10.2 That, this Hon'ble Court be pleased to issue a writ in the nature of certiorari/mandamus and direct the respondent No.2 & 3 to start deduction of contribution of Provident Fund from the wages of the petitioners from the date of their joining and deposit together with the employer's contribution with interest before the Respondent No.4. 10.3 That, this Hon'ble Court may be kind enough to direct the respondent No.2 & 3 to regularize the services of the petitioners looking to their service career, qualifications, seniority, experience, dedication and sincerity. 10.4 That, this Hon'ble Court be pleased to issue direction to the respondents establishment to allow minimum of the scale of regular post of Junior Assiatant (Typist) on the principle of 'equal pay for equal work'. 10.5 That, any other relief, which this Hon'ble Court may deem fit and proper in the facts and the circumstances of the case may also kindly be granted. 2. Learned counsel for the petitioners submits that the petitioners are employed as Junior Assistants (Typists) under respondent No.2 & 3. He further submits that the EPF contributions of the petitioners were not being deposited by the respondents No. 2 & 3 with respondent No.4. Thus seeking the above stated relief, this writ petition was filed. 3. Learned counsel for respondent No.4 submits that an amount of Rs.44,50,000/- has been recovered from the respondents No.2 & 3 towards the EPF contributions of their employees. He further submits that the recovery action taken by respondent No.4 is under challenge by respondents No.2 & 3 before the Central Government Industrial Tribunal cum Labour Court, Jabalpur (CGIT). At present as the grievances of petitioners as projected in the writ petition have been duly redressed by respondent No.4, this writ petition has become infructuous. 3 4. Learned counsel for respondents No. 2 & 3 submits that the action of respondents No. 2 & 3 by recovering the above stated amount is under challenge before the CGIT. 5. Learned counsel for respondent No.1 submits that the dispute is between the petitioners and respondents No. 2 & 3. 6. Be that as it may, as the submissions has been made by learned counsel for respondent No.4 that the EPF contribution for the employees of respondents No.2 & 3 to above stated amount has been recovered by it, though it is subject to challenge before the CGIT. For the present this writ petition is disposed of and liberty is reserved in favour of petitioners to file a fresh petition in case of any cause of action still subsists or any eventuality arise in the future. 7.
