Petitioner has filed this contempt petition alleging willful disobedience of respondents in not complying with the direction issued by this Court vide order passed in WPS No. 526/2013 dated 22.04.2024 between Rajdhani Yadav vs. Collector, Korea and another, and not giving entire back wages for which petitioner is entitled. 2. Learned counsel for respondents submits that respondents have complied with the order passed by this Court in its words and spirit. Pursuant to the order subject matter of the contempt petition, petitioner is reinstated and from the date of termination till its reinstatement back wages is calculated PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA 2 / 2 accordingly paid by the answering respondents and therefore the order has been duly complied with. 3. At this stage, learned counsel for petitioner submits that as subsequent to the order of reinstatement issued by the respondents, order of absorption of petitioner is pending consideration, and therefore, after absorption petitioner will be entitled for higher salary and accordingly the order is not complied with in its entirety. 4. I have heard learned counsel for the parties. 5. The order passed in the writ petition is of reinstatement in the service with 50% back wages. It is not disputed by the learned counsel for petitioner that pursuant to the order passed by this Court, petitioner is now reinstated in service and further that the respondents have also paid 50% of the back wages from March 2011 to November 2024. 6. In the aforementioned facts of the case, further considering that petitioner acknowledged receipt of Rs. 8,87,934 of March 2011 to November 2024. Balance against higher salary as claiming by petitioner if to be paid, is to be paid only after absorption of petitioner, which is still pending consideration and therefore in the opinion of this Court, respondents have complied with the order passed by this Court and therefore contempt proceedings initiated against respondents stands dropped.
