Mr. V.P. Singh, Mr. Deepak Maheshwari, Mr. Ashish and Mr. Jaidev, Advocates for respondent No.3. CORAM: HON'BLE MR. JUSTICE MANOJ JAIN J U D G M E N T (oral) CRL.M.A. 4758/2026 (exemption) Exemption allowed subject to all just exceptions. CRL.M.C. 1191/2026 1. Petitioner herein seeks quashing of FIR No.1134/2023 dated 09.09.2023, registered at Police Station Burari, Delhi, for commission of offences Sections 323/341/354D/509 IPC, along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties. 2. The abovesaid FIR was registered on the basis of the complaint made Signed By:SONIA THAPLIYAL Signing Date:22.08.2026 15:52:58 Signature Not Verified CRL.M.C. 1191/2026 2 by respondent No.3 herein, who knew petitioner beforehand. They became friends in the year 2017 and continued such relationship till 2020. Petitioner got married but according to respondent No.3, he kept on chasing her. As per her report, on 08.09.2023, he came to her flat and threatened her that he would commit suicide. When she tried to inform the police, he restrained her way and slapped her. It is in the abovesaid backdrop that the abovesaid FIR was registered. 3. The charge-sheet has already been filed and the case is at the stage of prosecution evidence. Respondent No.3 has already entered into witness box. 4. The quashing is, however, being sought as the matter has been amicably settled. 5. Copy of such Memorandum of Understanding (MoU)-cum-Settlement Agreement on 20.01.2026 has been placed on record. 6. Respondent No. 3 is present in-person and she has been duly identified by Investigating Officer as well as by her counsel. 7. When asked, respondent No. 3 submits that the settlement has taken place on account of intervention of well wishers, relatives and friends. She also submits that as per settlement, both the sides have agreed not to interfere in the life of each other. She submits that she has entered into the abovesaid settlement out of her own free will, without any coercion and influence from any corner whatsoever. Since the matter is now resolved, she does not wish to pursue the present FIR and would have ‘no objection’ if the FIR in question is quashed. 8. Petitioner is also present in Court and undertakes to adhere to the terms of abovesaid settlement. 9. In view of the settlement arrived at between the parties, continuing with Signed By:SONIA THAPLIYAL Signing Date:22.08.2026 15:52:58 CRL.M.C. 1191/2026 3 criminal proceedings would serve no useful purpose, especially, when dispute does not involve any public interest and is, primarily, private in nature. In any case, even the complainant does not wish to press any charges against the petitioner. 10. Accordingly, exercising inherent powers vested in this Court under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, it is deemed appropriate to quash the instant FIR. 11. Consequently, to secure the ends of justice, FIR No.220/2020 dated 07.08.2020, registered at Police Station Prasad Nagar, Delhi, for commission of offences Sections 498A/406/34 IPC, along with all consequential proceedings arising therefrom, is, hereby, quashed. 12. MoU-cum-Settlement Agreement dated 20.01.2026 and original affidavits of the parties, copies of which have been placed on record in the present proceedings, be submitted to the learned Trial Court within the period of four weeks, so that these become part of the Trial Court Record. 13. The petition stands disposed of in aforesaid terms. (MANOJ JAIN) JUDGE AUGUST 21, 2026/st/sa Signed By:SONIA THAPLIYAL Signing Date:22.08.2026 15:52:58
