1. On 06.08.2026 the following order was passed:
“1. At the outset, it is noted that the Petitioners have already availed of the remedy of appeal.
2. Ms. Shikha Sarin, Advocate, enters appearance on behalf of the Petitioners and submits that she has recently been engaged in the matter. She further submits that the Petitioners may be permitted to withdraw the present Writ Petition with liberty to file a fresh Writ Petition.
3. On a query put by the Court as to how the Petitioners can simultaneously approach two different forums by challenging the same order, learned counsel representing the Petitioners seeks an adjournment.

5. It is clarified that no further request for adjournment shall be entertained.”

Learned counsel representing the Petitioners does not dispute the pendency of the Appeal. However, she submits that the Petitioner became aware of Circular No.254/11/2025 dated 27.10.2025, whereby jurisdiction was assigned to the Assistant Commissioner. She further submits that, in terms of the said Circular, the Adjudicating Authority lacked jurisdiction to pass the impugned order.
3. This Court has considered the submission, however, finds that this issue can very well be taken up before the Appellate Authority, which is competent to adjudicate upon the aforesaid issue. Furthermore, continuation of two simultaneous parallel remedies against the common order would not be in the interest of justice. Hence, the Petitioner, if so advised, may take up this plea before the Adjudicating Authority.
4. In view of the aforesaid, the present Petition, along with pending applications, is disposed of.
