- 1 - acb19.25.odt IN THE HIGH COURT OF JUDICATURE OF BOMBAY BENCH AT AURANGABAD 953 APPLICATION FOR CANCELLATION OF BAIL NO. 19 OF 2025 XYZ ….Applicant VERSUS The State of Maharashtra & another …..Respondents Mr. Ajinkya Reddy, Advocate for Applicant Mr. S. P. Joshi, APP for the State. Mr. R. S. Shinde, Advocate for Respondent No. 2. CORAM : R. M. JOSHI, J. DATE : 6th OCTOBER, 2026. PER COURT : 1. This application is of the year 2025 for cancellation of bail granted to the contesting Respondent by order dated 07.02.2022 on the ground that the Respondent has breached the condition of bail by entering into Udgir city on 17.06.2022 and 09.10.2022. Apart from this, it is the contention of learned Counsel for the Applicant that the contesting Respondent has committed further crime in connection with the present Applicant. On this ground, he seeks cancellation of bail. 2. Learned Counsel for Respondent No. 2 opposes the said contention by submitting that the application came to be filed to seek - 2 - acb19.25.odt cancellation of bail by hook or crook. It is submitted that bail is granted in the year 2022 whereas there is no grievance made by the Applicant with regard to the contesting Respondent mis-using the liberty. It is his submission that the stage of the proceeding is for recording evidence of informant/prosecutrix. 3. Perusal of record indicates that liberty of the contesting Respondent was protected in the year 2022. The stage of the proceeding is for recording evidence of the informant/prosecutrix since 13.05.2025. It is for the prosecutrix to appear before the Court and complete examination-in-chief. There is nothing on record to indicate that the informant is being pressurised in any manner whatsoever in order to cancel the bail. Having regard to these facts, this Court finds no justification for cancellation of bail after lapse of about 4 years from grant of bail. Hence, application stands rejected. ( R. M. JOSHI, J.) dyb
