1. By virtue of the present petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner seeks the following reliefs:-
“1. Issue a writ of mandamus or any other appropriate writ, order or direction directing Respondent No.4 – Station House Officer, Police Station Sunlight Colony, under the supervision of Respondent Nos.2 and 3, to forthwith register FIR(s) on the basis of the Petitioner’s complaints dated 21.01.2023, 13.03.2024, 24.09.2024, 25.09.2024, 25.10.2024, 05.02.2025, 22.03.2025, 05.04.2025, 25.09.2025, 20.10.2025, 26.11.2025, 09.12.2025, 25.02.2026, 01.04.2026, 18.04.2026, 22.05.2026, 29.06.2026 and 10.07.2026, treating them as information disclosing cognizable offences in terms of Section 173 BNSS, 2023, and in accordance with the law laid down in Lalita Kumari v. 2. Direct that investigation of the said FIR(s) be conducted by an officer of appropriate seniority (not below the rank of Inspector, and if this Hon’ble Court so deems fit, by a specialised or supervisory unit within Delhi Police), ensuring a fair, impartial and time‑bound investigation into all incidents narrated in the Petitioner’s complaints, with periodic status reports being filed before this Hon’ble Court, if considered appropriate. 3. Issue appropriate directions to Respondents 2–4 to provide adequate and effective police protection to the Petitioner at her residence at E‑37, Siddharth Nagar, Sunlight Colony, Ashram, New Delhi – 110014, including by periodic patrolling / deployment as deemed appropriate, so that she may live in safety and pursue her legal remedies without fear of further assaults or intimidation, particularly from residents of E‑36, E‑39 and E‑40 in the said locality. 4.
Direct Respondent No.2 (Commissioner of Police) or a senior officer not below the rank of Joint Commissioner of Police to conduct an independent enquiry into the conduct of the officers of Police Station Sunlight Colony and other concerned officials in relation to the Petitioner’s complaints dated 21.01.2023, 13.03.2024, 24.09.2024, 25.09.2024, 25.10.2024, 22.03.2025, 05.04.2025, 25.09.2025, 20.10.2025, 26.11.2025, 09.12.2025, 25.02.2026, 01.04.2026, 18.04.2026, 22.05.2026, 29.06.2026 and 10.07.2026 to ascertain the reasons for non‑registration of FIR(s) and non‑grant of effective protection, and to take appropriate departmental and other action against any officer found to have wilfully or negligently failed to perform his/her statutory duties, in line with the directions in Lalita Kumari. 5. Direct that appropriate action be taken against the Respondent No.4 (Station House Officer) and PCR vehicle staff who did not attend the emergency call of the Petitioner and concerned IO of the PCR call and concerned IO for the written complaints submitted by the Petitioner. 6. Court may deem fit and proper in the facts and circumstances of the present case, in the interest of justice.”

At the outset, considering that the incidence sought to be projected by the petitioner commenced way back on 21.01.2023 and, according to her even though the various incidents have been persisting till date since then, she has never initiated any proceedings for registration of any FIR(s) till date under Section 173(1) of the BNSS, and has now directly approached this Court, as also in view of the prayers sought herein, the present petition per se is not maintainable. 3.
Learned ASC appearing on advance notice submits that even though the petitioner herein is a habitual complainant, all the complaints made by her have always been duly looked into on a regular basis. She submits that she has not approached the IO even a single time thereafter. She lastly submits that upon verification of her various complaints, the assertions made therein have been found to be false/ baseless and without any substance. 4. The above contentions are denied by learned counsel for the petitioner. 5. In any event, for the aforesaid reasons, since the present petition is not maintainable, the same is disposed of with liberty to seek appropriate remedies in accordance with law. SAURABH BANERJEE, J.
