It is the grievance of the petitioner that the application under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act (in 2026:JHHC:16319 2 short, SARFAESI Act) is kept pending before the District Magistrate, Dhanbad for more than the statutory period. He submits that suffice it would be if a direction is given to the District Magistrate, Dhanbad to pass an appropriate order on the petition filed by the petitioner under Section 14 of the SARFAESI Act. 3. This Court in several cases has held that any petition filed under section 14 of the SARFAESI Act should be dealt expeditiously by the District Magistrate and the same cannot be kept pending for indefinite period. As per section 14 of SARFAESI Act maximum of 60 days is granted to the District Magistrate to pass an order on the said application. The time which has been mentioned should be adhered to and the District Magistrate cannot sit over the same as any delay by the said Authority will frustrate the provision of the Act. 4. Thus, I direct the District Magistrate, Dhanbad/ Deputy Commissioner, Dhanbad to pass an appropriate order on the application filed by the petitioner preferably within a period of three weeks from the date of receipt of the copy of this order. 5. With the aforesaid directed and observation, this writ petition is disposed of. (ANANDA SEN, J.) 08.06.2026 Tanuj/CP-2 Uploaded on 11.06.2026
