By virtue of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the petitioners seek quashing of FIR No.626/2014 dated 28.07.2014 registered at PS.: Punjabi Bagh, Delhi under Sections 323/342/34/365 of the Indian Penal Code, 1860 (IPC) and all proceedings emanating therefrom as the petitioners and respondent nos.2 to 4 have mutually settled all their disputes vide Memorandum of Settlement dated 14.01.2026. Learned counsel for the respondent nos.2 to 4 also accepts notice and submits that the respondent nos.2 to 4 have no objection if the present petition is allowed. 5. This Court has further had the occasion of interacting with the petitioners as well as the respondent nos.2 to 4, who all are present in Court. They affirm the terms of the aforesaid Memorandum of Settlement dated 14.01.2026, whereby the petitioners have paid the respondent nos.2 to 4 a total sum of Rs.4,00,000/-, by way of a Demand Draft being DD No714577 dated 25.05.2026 drawn on Punjab National Bank as full and final settlement of all his present, past and future claims and as such, the parties have agreed to put a quietus to their disputes. Respondent nos.2 to 4 hence submit that they do not wish to continue with the aforesaid FIR against the petitioners. 6. The petitioners and the respondent nos.2 to 4, present in Court, as well as their credentials, as on record, have been duly identified by the IO. 7. As noted above, a settlement based on mutual terms between the petitioners and the respondent nos.2 to 4 is the basis of filing the present petition, which is accompanied by their respective affidavit(s) qua the said effect. In view thereof, the present is a fit case for quashing the aforesaid FIR. Accordingly, following the law laid down by the Hon’ble Supreme Court in Jitendra Raghuvanshi & Ors. vs. Babita Raguvanshi & Anr.: (2013) 4 SCC 58, Gian Singh vs. State of Punjab & Anr.: (2012) 10 SCC 303 and Narinder Singh & Ors. vs. State of Punjab & Anr.: (2014) 6 This is a digitally signed order. At this stage, the petitioners appearing in person, as a gesture of goodwill have willingly agreed to treat all the students of Class I to V of the below mentioned Government School with a packet of snacks, after ascertaining the time for the same from the concerned Principal. Additionally, respondent no.3 appearing in person also expresses to perform a small program for all the students of the above-mentioned school, after co-ordinating with school Principal. 10. This Court appreciates the aforesaid gesture of goodwill shown by the petitioners and the respondent no.3 herein. 11. Accordingly, the present petition is allowed and FIR No.626/2014 dated 28.07.2014 registered at PS.: Punjabi Bagh, Delhi under Sections 323/342/34/365 of the IPC and all proceedings emanating therefrom are hereby quashed. 12.
