[2026:RJ-JP:6494] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 1478/2026 Emran S/o Basheer, Aged About 36 Years, R/o Dundawal, Police Station Nagar, District Deeg. (Currently In District Jail, Deeg). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Harendra Singh with Mr. Shivam Sharma and Mr. Mohan Lal For Respondent(s) : Mr. Vivek Sharma, PP HON'BLE MR. JUSTICE SANDEEP TANEJA Order 11/02/2026 1. The present bail application has been filed by the accused- petitioner under Section 483 of B.N.S.S. in connection with F.I.R. No.220/2025 registered at Police Station Nagar, District Deeg for the offence(s) punishable under Section(s) 189(2) and 103(1)of B.N.S. However, after investigation, the police has found that offence under Section 108 B.N.S. is made out against petitioner. 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and has nothing to do with the alleged offence. Learned counsel further submits that there arose a quarrel between the petitioner and the deceased due to regular consumption of liquor by the petitioner, which is supported by the statement of the children of petitioner recorded under section 183 BNSS. Learned counsel also submits that the petitioner had not directly or indirectly encouraged, provoked, or urged the deceased to take her own life, so ingredients of Section 108 BNS are not being made out. Learned counsel further submits that the petitioner is in judicial custody since 09.12.2025; he has [2026:RJ-JP:6494] (2 of 2) [CRLMB-1478/2026] no criminal antecedent; charge-sheet has already been filed in the matter and conclusion of trial will take considerable time, so no fruitful purpose would be served by keeping the petitioner into custody, and therefore prays to enlarge the petitioner on bail. 3. Learned counsel for the petitioner has placed reliance upon the following Judgments:- 1. Sanju Alias Sanjay Singh Sengar Vs. State of Madhya Pradesh, reported in (2202) 5 SCC 371; 2. Swamy Prahaladdas Vs. State of Madhya Pradesh and Anr., reported in 1995 Supp (3) SCC 438. 4. Learned Public Prosecutor opposes the submissions made by learned counsel for the petitioner hereinabove. 5. Taking into consideration the overall facts & circumstances of the case; the arguments advanced by learned counsel for the petitioner, the fact that charge-sheet has been filed in the matter, and petitioner has no criminal antecedent as well as trial will take considerable time in its conclusion, without commenting anything upon the merits / demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail. 6. Therefore, the bail application under Section 483 B.N.S.S. is allowed and the accused-petitioner, namely Emran S/o Basheer, is ordered to be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the trial Court, with the stipulation that the petitioner shall appear before that Court on all subsequent dates of hearing and as and when he is called upon to do so.
