The petitioner is apprehending his arrest in connection with Maheshpur P.S. Case No. 95 of 2024 corresponding to G.R. No. 586 of 2024, registered for the offence under Sections 310(2) and 317(3) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Chief Judicial Magistrate, Pakur. 3. Learned counsel appearing for the petitioner submits that the petitioner has been made accused only on the basis of confessional statement of apprehended co-accused and further in para-51 of the case diary, it has been disclosed that the petitioner is having no criminal antecedent. He next submits that what has happened that has been done by the other co-accused persons and one of the co-accused has also been granted regular bail. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the petitioner was accomplish of the apprehended co-accused, who has taken the name of this petitioner. 5. Considering that only on the basis of confessional [2026:JHHC:16696] -2- statement, the name of the petitioner has come and further in para-51 of the case diary, it has been disclosed that the petitioner is having no criminal antecedent, I am inclined to grant anticipatory bail to the petitioner, above named. 6. Accordingly, the petitioner, named above, is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Pakur, in connection with Maheshpur P.S. Case No. 95 of 2024 corresponding to G.R. No. 586 of 2024, subject to conditions as laid down under Section 482 (2) of Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.)
