1. Petitioner has filed this writ petition seeking following reliefs:
“i. Issue an appropriate writ, order or direction in the nature of Mandamus, directing the Respondent authorities to release forthwith the Petitioner's lawful one-fourth share in the service and retiral dues payable in respect of Late Tomesh Singh Rajput, in terms of the final judicial determination and Succession Certificate, within a time-bound period as may be fixed by this Hon'ble Court, ii. Direct the Respondent authorities to complete all consequential formalities and ensure actual disbursement of the Petitioner's dues within the stipulated period without raising any further objection or causing avoidable delay; iii. Direct the Respondent authorities to pay interest on the delayed payment of the Petitioner's lawful dues at such rate as his Hon'ble Court may deem fit and proper, considering the prolonged and unjustified withholding of the amount, iv. Award costs of the present petition in favour of the Petitioner and against the Respondents, in view of
3 / 4 the arbitrary and unreasonable conduct of the Respondents which has compelled the Petitioner, a senior citizen, to approach this Hon'ble Court, v. And/or Grant any other relief(s) as this Hon'ble Court may deem fit, just and proper in the facts and circumstances of the case, in the interest of justice.

Learned counsel for the petitioners at the outset submit that claim of petitioner is already pending consideration before respondents No. 1 & 2 and they be directed to take decision on claim of petitioner in accordance with the order passed by competent Court on 05.05.2025 in a proceeding filed by petitioner.

Learned counsel for respondent No.1 submits that earlier respondent No.3 has filed writ petition before this Court bearing WPS No.4626 of 2020 which was disposed of on 08.12.2020 directing respondent therein to take decision on the claim of petitioner for grant of relief as prayed for by the petitioner therein including relief of death -cum -retiral dues and dependent employment. He submits that pursuant to order, dependent employment has already been given to respondent No.3. With regard to petitioner’s claim of monetary benefit against death cum retiral dues of deceased employee is concerned, her claim will be considered in accordance with law and appropriate order will be passed.

Learned counsel for respondent No.2 also submits that petitioner has not submitted any representation before respondent No.2, however, the insurance company has also been arrayed as party even then.

5. At this stage, learned counsel for the petitioner submits that he may be permitted to file fresh representation before respondent No. 2 also.

Considering submissions of learned counsel for the parties, I am inclined to disposed of this writ petition at this stage permitting the petitioner to submit fresh representation before respondents No. 1& 2 and if such representation is submitted, concerned authority shall consider and take decision on the same in accordance with law, expeditiously, preferably within a period of 2 months from the date of receipt of representation.
7. With the aforesaid observation and direction, writ petition stands
