P.P. …...... 02/ 09.03.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as they are in custody for allegedly committing offence punishable under Sections 126(2), 127(2), 70(2), 351(2) & 351(3) of BNS and Section 4 & 6 POCSO Act. 2. Heard, learned counsel for the petitioners, learned counsel for the State and have also gone through the impugned order. 3. Learned A.P.P. opposes the prayer for bail. 4. There is direct allegation against these petitioners and others of committing gang rape upon the victim. Though the petitioners’ counsel tries to impress this Court that there was no injury found, but considering the direct nature of allegation, I am not inclined to grant privilege of bail to the petitioners. Accordingly, the prayer for bail of the petitioners in connection with Special (POCSO) Case No.95 of 2024 arising out of Baorijore P.S. Case No.22 of 2024, pending in the Court of learned Special Judge (POCSO), Godda stands rejected. 5. Accordingly, the instant bail application stands dismissed.
