Learned Additional Government Advocate raises a preliminary objection that the order impugned at Annexure-E is passed by the Assistant Commissioner, Ramanagara Sub- Division, invoking Rule 108(K) of the Karnataka Land Revenue Rules, 1966 (for short 'the Rules') while cancelling the grant made in favour of the petitioner. Such an order if considered as original order passed by the Assistant Commissioner under Rule 108(K) of the Rules, then the appeal would lie to the Deputy Commissioner under Section 49(b) of the Karnataka Land Revenue Act, 1964 (for short 'the Act'). If the order impugned is considered an order under appeal under Section 49(b) of the Act, then a second appeal would lie to the Deputy Commissioner under Section 50 of the Act.
