1. Heard Dr. Neelkamal Garg, Petitioner in Person. Also heard Mr. Shaleen Singh Baghel, learned Govt, Advocate, appearing for the Respondent/State. 2. This appeal is directed against an order dated 09.09.2025 passed by learned Single Judge in Contempt Case No. 1384 of 2025, whereby the learned Single Judge dismissed the contempt petition filed by the petitioner. 3. The prayer made in the writ petition read as follows:

4. The Registry has raised objection regarding maintainability of the present writ appeal as the same has been filed against the order passed by learned Single Judge in Contempt Case No. 1384 of 2025. 5. Mr. Shaleen Singh Baghel, learned Govt.
Advocate for the Respondent/State submits that this appeal is not maintainable in view of the provisions contained in Section 2 (1) of the Chhattisgarh High Court (Appeal to Division Bench) Act, 2006, for short, the Act of 2006, which specifically provides that no writ appeal shall be lie against the order passed in contempt proceeding. 6. Section 2(1) of the Chhattisgarh High Court (Appeal to Division Bench Act, 2006) reads as follows:
“2. Appeal to the Division Bench of the High Court from a Judgment or order of one judge of the High Court made in exercise of original jurisdiction. - (1) An appeal shall lie from a
judgment or order passed by one judge of the High Court in exercise of original Jurisdiction under Article 226 of the Constitution of India, to a Division Bench comprising of two Judges of the same High Court. Provided that no such appeal shall lie against an
4 interlocutory order or against an order passed in exercise of supervisory jurisdiction under Article 227 of the Constitution of India.”
7. A perusal of the above goes to show that no writ appeal shall lie before the Division Bench against the order passed in contempt proceeding.
8. In that view of the matter, this appeal is not maintainable and accordingly, the same is dismissed as not maintainable, with the liberty to the writ appellant to take recourse to law in appropriate proceeding. Sd/- Sd/- (Ravindra Kumar Agrawal) (Ramesh Sinha)
