[2026:RJ-JP:13001] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous IInd Bail Application No. 15048/2025 Satyaveer S/o Sh. Mohan, R/o Adhnanur, Police Station Mania, District Dholpur. (At Present Confined In District Jail Dholpur) ----Accused/Applicant Versus The State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Mohammand Shahid Hassan For Respondent(s) : Mr. Devi Singh, Dy.G.A HON'BLE MR. JUSTICE ASHUTOSH KUMAR Order 27/03/2026 1. The first bail application filed on behalf of the accused-applicant has been dismissed vide order dated 31.07.2025 by this Court passed in S.B. Criminal Miscellaneous Bail Application No.14011/2024. 2. This second bail application has been filed by the accused- applicant under Section 483 of B.N.S.S., 2023 in connection with FIR No.288/2024, registered at Police Station Mania District Dholpur for the offences punishable under Section 302 of IPC. 3. Learned counsel for the accused-applicant submits that the accused-applicant has falsely been implicated in this case. Learned counsel also submits that the accused-applicant has been made accused in this case on the basis of last scene evidence of witnesses namely Girraj, Rajendra and Manoj recorded under Section 180 of B.N.S.S and also, on the basis of so called [2026:RJ-JP:13001] (2 of 3) [CRLMB-15048/2025] telephonic conversation with the main accused- Pankaj. Learned counsel further submits that, subsequent to the rejection of the first bail application, the evidence of the so-called “last seen” witnesses, namely Girraj, Rajendra and Manoj, have since been recorded before the learned Trial Court as PW-3, PW-4 and PW-5, respectively. Learned counsel further submits that all the aforesaid three witnesses have turned hostile and have not supported the prosecution case; they have specifically denied the allegation that, on the date of the fateful incident, they had seen the accused- Satyaveer in the company of the co-accused Pankaj and the deceased- Sukkhan. 4. Learned counsel for the accused-applicant contends that the accused-applicant is 18 years of age; that accused-applicant was arrested on 04.07.2024 and since then, he is behind the bars and that trial is likely to take long time to conclude. Therefore, it is prayed that the accused-applicant be granted benefit of bail. 5. Learned counsel appearing on behalf of the State vehemently opposes this bail application on the ground of seriousness of the allegation leveled against the accused- applicant. 6. Heard learned counsel for the parties and also perused the material available on record. 7. Admittedly, the accused-applicant was allegedly last seen with the main accused- Pankaj and the deceased- Sukkhan by witnesses namely Rajendra, Girraj and Manoj, therefore, evidence has been recorded by the learned trial Court. The aforesaid three witnesses have turned hostile since they have not supported the [2026:RJ-JP:13001] (3 of 3) [CRLMB-15048/2025] prosecution story and the fact that the accused-applicant is behind the bars since the date of his arrest i.e. 04.07.2024. 8. Considering the overall facts and circumstances of the case, looking to the age of the accused-applicant, period of incarceration and nature of evidence which has come on record so far, but without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow this second bail application filed by the accused-applicant. 9. Consequently, this second bail application filed under Section 483 of the B.N.S.S., 2023 is allowed. It is ordered that accused- applicant Satyaveer S/o Sh. Mohan arrested in connection with FIR No. 288/2024, registered at Police Station Mania District Dholpur shall be released on bail; provided each of them furnishes personal bond in the sum of Rs.1,00,000/- each and two solvent sureties of Rs.50,000/- each to the satisfaction of the learned trial Court. Applicant shall be required to appear before that Court on all dates of hearing and as and when called upon to do so. (ASHUTOSH KUMAR),J TANISHA /3
