This is a consecutive application seeking withdrawal of the amount deposited by the acquiring body/appellant in this Court. 2. It is submitted that initially, under the orders passed by this Court, the acquiring body/appellant deposited only 50% of the award amount which was withdrawn by the applicants. Subsequently, the acquiring body deposited the balance amount in this Court under the orders passed by this Court. Now, this application is filed for permission to withdraw the balance amount. 3. Mr. V. B. Patil, learned Advocate for the applicants submits that in the connected matters, the acquiring body was 3 933 CA 11318 OF 2026 permitted to deposit the entire award amount which was allowed by this Court to be withdrawn by the applicants. Copy of the order dated 30.06.2026 is placed on record. 4. It is not in dispute that the applicants' sole source of livelihood is acquired by the acquiring body under the compulsory land acquisition procedure. The only issue is about the quantum of compensation. 5. In the light of the fact that the interest of the acquiring body needs to be protected, the applicants are permitted to withdraw the balance amount. 6. In view of this, to meet the ends of justice, I pass the following order : O R D E R I. Civil Application is allowed. II. The applicants are permitted to withdraw the balance amount deposited by the acquiring body in this Court along with accrued interest by furnishing usual undertaking to the satisfaction of the learned Registrar (Judicial) of this Court.
