JUSTICE H.T NARENDRA PRASAD ORAL ORDER In this writ petition, petitioner has sought for the following reliefs: "i) issue a writ in the nature of mandamus directing the Hon'ble XXXI Addl. City Civil and Sessions Judge, Bengaluru (CCH-14) to dispose of the interlocutory application numbered as I.A.No.3 filed by the Petitioner herein/Plaintiff under Section 151 of the Code of Civil Procedure, 1908 in O.S.No.1459/2025 vide Annexure-E, within a period of thirty (30) days from the date of disposal of the present Writ Petition; ii) Pass any other order/issue any writ or direction which this Hon'ble Court deems fit in the circumstances of the case." 2. For the sake of convenience, the parties are referred to as per their ranking before the Trial Court in Original Suit. 3. The plaintiff has filed a suit for injunction in O.S.No.1495/2025 before the XXXI Addl. City Civil and Sessions Judge, Bengaluru (for short ‘Trial Court’). Along with the suit, plaintiff filed application I.A.No.1/2025 under Order XXXIX Rule 1 and 2 r/w Section 151 of CPC seeking - 4 - HC-KAR NC: 2026:KHC:24062 WP No. 9333 of 2026 temporary injunction order. The Trial Court on 28.02.2025 has granted ex-parte temporary injunction order and the same is extended from time to time. After issuance of suit summons, the defendants appeared through counsel. Since, the defendants have disobeyed the injunction order passed by the trial Court, the petitioner has filed an application I.A.No.3 seeking for police protection. So far, no order has been passed on the said application. Hence, the petitioner is before this Court. 4. In view of the above, without expressing any opinion on the merits of case, the Trial Court is directed to consider the application, I.A.No.3 filed by the petitioner- plaintiff in accordance with law, as expeditiously as possible, but not later than end of June, 2026.
