Mishra, learned counsel for the petitioner that in the 163 BNSS proceedings, the opposite parties have already put in appearance. Heard Mr. Abhay Kr. Mishra, learned counsel for the petitioner and learned Sr. S.C.-II. In this writ application the petitioner has prayed for a direction upon the concerned respondents to dispose of Cr. Misc. Case No.454 of 2025 pending before the Sub-Divisional Officer, Mahagama instituted an application preferred under Section 163 of BNSS. It has been submitted by the learned counsel for the petitioner that during the pendency of the 163 BNSS proceedings the private respondents are trying to disturb the petitioner and illegally encroach upon the land of the petitioner. In view of the limited prayer made in this writ application, the same stands disposed of with a direction to the Sub-Divisional Officer, Mahagama (respondent no.2) to dispose of Cr. Misc.
