JUSTICE ANU SIVARAMAN) This Contempt of Court case is filed alleging non compliance of judgment dated 27.11.2022 of the learned Single Judge in W.P.No.1432/2022. 2. We have learned the learned counsel appearing on either side. 3. The operative portion of the judgment in W.P.No.1432/2022 reads as under: "3. In view of the submission of the learned counsel that seniority of the petitioner has been re-fixed at Sl.No.236 above the name of Sri.G.B.Dumbal, it would be appropriate to direct the second respondent to consider the case of the petitioner for promotion to the post of Chief Officer Grade-2 and Grade-I with effect from 29.04.2016 and 13.12.2019 and place him above the name of Sri.G.B.Dumbal and others. 4. The second respondent shall also consider the case of the petitioner to the post of Municipal Commissioner Grade-II, in the same manner as has been done in respect of Sri.G.B.Dumbal and give the petitioner appropriate seniority. This exercise shall be completed within two months from the date of receipt of a certified copy of this order. - 4 - HC-KAR NC: 2026:KHC:13611-DB CCC No. 864 of 2024 5. It is needless to state that, as a matter of fact, Sri.G.B.Dumbal and others have been granted promotion and the petitioner has not been accorded promotion despite his admitted re-fixation of seniority, the respondents would be bound to promote the petitioner to the said post and the petitioner would also have to be placed above them." 4. The learned Additional Government Advocate appearing for the accused submits that the directions have now been complied with and that an order has been passed on 10.11.2025, granting permission to the complainant as directed. The proceedings dated 10.11.2025 are also placed on record along with a memo. 5. The learned counsel appearing for the complainant submits that the directions have been complied with after a long delay and that no consequential benefits have been granted to the complainant. 6. Since the directions have now been complied with although belatedly, we are of the opinion that the further contentions which are not covered by the judgment of which contempt is alleged, cannot be taken up in these proceedings. - 5 - HC-KAR NC: 2026:KHC:13611-DB CCC No. 864 of 2024 7. In view of the above, the Contempt of Court case is closed, leaving open all the contentions of the complainant to be agitated in appropriate proceedings.
