For the Informant : Mr. Preetam Mandal, Advocate ------ Order No.02 Dated- 10.06.2026 Heard the parties. The petitioner has moved this Court for grant of bail in connection with Karmatanr P.S. Case No.71 of 2024 registered for the offences punishable under sections 147, 148, 149, 341, 323, 307, 379 and 504 of the Indian Penal Code. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was the member of an unlawful assembly and in prosecution of common object of the assembly attempted to murder the informant Basudev Mandal by assaulting him on his head with an iron rod. It is further submitted that the allegations against the petitioner are all false. It is next submitted that for the self-same occurrence, from the side of the petitioner, the mother-in-law of the petitioner has also lodged Karmatanr P.S. Case No. 72 of 2024. It is further submitted that there was a free fight between the parties in respect of a land dispute and the petitioner has no intention to kill anyone. It is next submitted that Title Suit No. 103 of 2023 is pending in the Court of Learned Civil Judge (Sr. Division)-I, Jamtara between the mother-in-law of the petitioner and the informant and the genesis of the occurrence is a land dispute. It is then submitted that the petitioner has been in custody since 31.03.2026, as has been mentioned in paragraph no. 12 of the bail application. It is further submitted that the petitioner undertakes to cooperate with the trial of the case and further undertakes that he will not annoy or disturb the informant or his family members or the witnesses of the case in any manner during the trial of the case. Hence, it is submitted that the petitioner be admitted to bail. The learned Addl. P.P. and the learned counsel for the informant opposes the prayer for bail. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the above-named petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamtara, in connection with Karmatanr P.S.
