[2026:RJ-JP:12021] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 1641/2026 Pinki Gurjar D/o Shri Bahadur Singh, Aged About 25 Years, R/o Kharagpur, Police Station Kaulari, District Dholpur. ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Sachin Kumar For Respondent(s) : Mr. Vivek Sharma, PP HON'BLE MR. JUSTICE SAMEER JAIN Order 23/03/2026 1. The present bail application has been filed under Section 482 BNSS in connection with FIR No. 322/2025 registered at Police Station Nihalganj District Dholpur for the offence(s) under Sections 318(4), 319(2) and 61(2)(b) of the IPC and 3, 4, 6 of the Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) Act, 2022. 2. Learned counsel for the accused-applicant has submitted that the applicant is a young and unmarried girl. It is submitted that the applicant has falsely been implicated in the matter as her name is involved in the FIR without doing any prima facie investigation. It is also submitted that there are no criminal antecedents registered against the applicant. 3. Per contra, learned Public Prosecutor has vehemently opposed the present bail application. [2026:RJ-JP:12021] (2 of 2) [CRLMB-1641/2026] 4. Having heard the contentions made by the counsel representing both the parties, upon a perusal of the material available on record, it is clear that the grave allegations of impersonation in a public examination have been leveled against the applicant; that there was a mismatch in the bio-metrics of the applicant while she was attempting the examination on behalf of other person; that there is an application of the Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) Act, 2022 in the present matter, where rigorous measures have been taken on account of unfair measures adopted by the candidates, and looking to the overall facts and circumstances, but without commenting on merits/demerits of the case, the interference of this Court is not warranted in the factual disputed matter and this Court is inclined to dismiss the present bail application. 5. Accordingly, the anticipatory bail application stands dismissed. 6. Howsoever, the accused-applicant would be at liberty to surrender himself before the learned Trial Court concerned. The said Court is directed to consider the application so moved, or plea so made by the surrendering accused-applicant on the very same date. (SAMEER JAIN),J RAHUL KUMAR /9
