GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed for the following relief: “…pleased to issue an appropriate Writ order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents No 4 and 5 and his subordinates in interfering with petitioner personal life and liberty by calling petitioner to his Police Station and pressurizing petitioner to get settled the dispute with the respondents No 7 and 8 with regard to subject property of O S No 347 of 2025 and O S No 348 of 2025 on the file of the Court of the Junior Civil Judge Palamaner by handing over the vacant possession of the same as arbitrary illegal colorable exercise of power and voilative of fundamental rights guaranteed to petitioner under Articles 14 19 and 21 of the Constitution of India and consequently direct the respondents No 4 and 5 not to interfere with petitioner personal life and liberty by calling petitioner to his Police Station and pass…” 2. Heard learned counsel for the Petitioner and the learned Assistant Government Pleader. 3. Learned counsel for the Petitioner submits that Respondent Nos. 4 and 5, at the instance of Respondent Nos. 7 and 8, have been calling the Petitioner to the police station and insisting that the Petitioner to compromise the civil dispute with regard to the subject property in O.S. No. 347 of 2025 and O.S. No. 348 of 2025, which are pending adjudication, on the file of the learned Junior Civil Judge, Palamaner. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that the respondent/ police never called the Petitioner to the police station nor pressurized the Petitioner to settle the dispute with Respondent Nos. 7 and 8, but only acted upon the complaints lodged by the Petitioner as well as Respondent Nos. 7 and 8 against each other, and that the said cases are under investigation. 5. Considering the facts and circumstances of the case, and recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of, directing Respondent Nos. 4 and 5 not to interfere henceforth in the civil dispute between the Petitioner and Respondent Nos. 7 and 8 without following due process of law. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. ________________________ Dr. Y.
