JUSTICE PRAMIL KUMAR MATHUR
Order 27/01/2026
1. The petitioner has filed this bail application under Section 483 of BNSS in FIR No.248/2025 registered at Police Station Transport Nagar, Jaipur City (East), for offence under Sections 103(1), 55, 111(3), 310(4), 310(5) BNS-2023 and Section 3 /25, 25(6), 26(8) of Arms Act.
2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record.
3.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that the sole allegation against the petitioner is that he had allegedly called the persons named in the FIR to commit the murder of a businessman. It is argued that nothing has been recovered from
[2026:RJ-JP:3547] (2 of 3) [CRLMB-1489/2026] the present petitioner and that he has been implicated only on the basis of the disclosure statement of another co-accused. Learned counsel vehemently contends that for invoking the provisions relating to organised crime under Section 111 of the BNSS, there must be material on record to show the existence of more than one charge-sheets, filed within the preceding period of ten years; however, no such material has been produced by the prosecution. He submits that merely on false and concocted grounds, the petitioner has been arrested in the present case. It is further submitted that the petitioner has been in judicial custody since 20.10.2025 and the charge-sheet has already been filed. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody and the bail application of the petitioner may be allowed.
4. Learned Public Prosecutor has vehemently opposed the bail application.
5. On consideration of the rival submissions and material available on record and in the light of submission made by learned counsel for the petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner.
6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Santoshi @ Bhura Gurjar S/o Rasal Singh, be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before
[2026:RJ-JP:3547] (3 of 3) [CRLMB-1489/2026] that Court on all subsequent dates of hearing till conclusion of the trial.
