It is a case where the proceeding for contempt has been sought to be initiated against the opposite parties for alleged willful and deliberate non- compliance of the Judgment dated 11.09.2023 passed in L.P.A. No. 307 of
2020.
2. We have passed several orders in the contempt case which is after the
order passed by the Hon’ble Supreme Court having been declined to interfere with vide its order dated 13.09.2024 passed in S.L.P. (C) Diary No. 27208 of 2024.
3. Show-cause has been filed on 15.05.2026 by making a reference of the enquiry report as has been appended in the show-cause dated 25.02.2026 (Flag-H).
4. Mr. Indranil Bhaduri, learned SC-IV by referring to the report of the enquiry committee, has submitted that quantum of loss to the State exchequer has been assessed by the committee is around Rs. 99.67/- lakhs. He therefore, has submitted that even if the life expectancy of the petitioner

is considered as 90 years and pension revision after every ten years as well as increase in dearness allowance every six month, yet the total loss of amount Rs. 99.67/- Lakh to State exchequer caused due to the petitioner action cannot be recovered from his pension.

Learned counsel appearing for the concerned opposite party has therefore submitted that now the entire calculation of the amount has been made and as such, the order has fully been complied with.
6. Upon this, the learned counsel appearing for the petitioner has submitted that the contempt case may be disposed of by closing it by granting liberty to the petitioner to challenge the aforesaid calculation.
7. The said submission has not been disputed by the concerned learned counsel appearing for the opposite parties-Mr. Indranil Bhaduri.
8. Considering the submissions made on behalf of the petitioner, the contempt case is being closed and disposed of. However with the liberty to the petitioner to challenge the enquiry committee report assessing the quantum of amount before the appropriate forum, if the petitioner so wishes.
9. The contempt case is accordingly, disposed of.
