1. The present petition has been filed alleging wilful disobedience and non-compliance of the Memorandum of Understanding cum Settlement Agreement (“Settlement Agreement”) dated 08th August, 2023.

The petition further alleges wilful disobedience of the statements given by the respondent vide order dated 09th August, 2023, passed by the Principal Judge, Family Court, Patiala House Courts, New Delhi in HMA 796/2023, whereby, the respondent had agreed to comply with the terms of the Settlement Agreement.

Learned counsel appearing for the petitioner on instructions from the petitioner submits that the main cause of grievance of the petitioner-mother is that the video calls which she makes to the minor daughter are not being Digitally Signed By:HARIOM SHARMA Signing Date:23.08.2026 10:20:14 Signature Not Verified
honored.
4. This Court is informed that the petitioner-mother has the right to video call her daughter every day between 06:00 PM to 07:00 PM Indian Time (“IST”)
5. However, on account of the discussion between the petitioner-mother and the respondent-father, the said video calls were rescheduled for 08:00 PM to 09:00 PM IST.
6. Today, this Court is informed that the minor daughter is unable to speak to the petitioner-mother at such late hours since she is exhausted by that time.

Learned counsel appearing for the petitioner further submits that the regular progress of the minor daughter is also not informed to the petitioner and the petitioner-mother is not aware of the day-to-day academic progress of the minor daughter.
8. Per Contra, learned counsel appearing for the respondent submits that all the academic progress and other activities of the minor daughter are regularly being informed to the petitioner-mother.
9. At this stage, petitioner appearing before this Court through Video Conferencing (“VC”) submits that she will make all efforts to build bridges with her minor daughter.
10. Considering the submissions made before this Court, the following directions are issued: i. The petitioner-mother shall call the minor daughter between 06:00 PM to 07:00 PM IST. However, the petitioner-mother shall also honor and respect the daughter’s intention in case she is tired or busy in any other activity. ii. when the petitioner-mother video calls the minor daughter during the above time, the minor daughter is available to speak to the petitioner- mother. iii. The respondent-father shall regularly update the petitioner- mother through E-mail about the minor daughter’s progress in school, including, the results, and other activities like annual day or any other cultural program in which the minor daughter takes part in the school or outside the school. iv. The parties are directed to comply with the various clauses of the Settlement Agreement dated 8th August, 2023, including, Clause-g of the same.
11. With the aforesaid directions, the present petition is accordingly,
disposed of.
12. All the pending applications also stand disposed of.
