Revision Case before this Hon'ble Court and to pass Counsel for the Petitioner: 1. VENKATA DURGA RAO ANANTHA Counsel for the Respondent: 1. PUBLIC PROSECUTOR The Court made the following: COMMON ORDER: This Criminal Revision Case is filed under Sections 438 and 442 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), seeking to set aside the Order dated 18.04.2024 passed in Crl.M.P. No.18 of 2024 in Crime No.171 of 2023 of Kothapet Police Station by the learned Principal Sessions Judge, Guntur, whereby the anticipatory bail granted to the petitioner/A3 was cancelled. 2. I.A. No.1 of 2025 is filed seeking condonation of delay of 561 days in filing the present Criminal Revision Case. 3 3. The case of the prosecution, in brief, is that a case in Crime No.171 of 2023 was registered on 03.06.2023 for the offences punishable under Sections 489-A, 489-B and 489-C IPC against A1. Subsequently, during the course of investigation and based on the confession of the co-accused, the petitioner was arrayed as A3. The allegation pertains to circulation of fake currency notes at S.S. Seven Wonders Exhibition, Guntur, wherein fake currency notes of Rs.500/- denomination were seized from A1 and A2. The petitioner filed Crl.M.P. No.895 of 2023 before the learned Principal Sessions Judge, Guntur, seeking anticipatory bail, and the same was allowed on 23.08.2023 subject to certain conditions, including appearance before the respondent police on every first and third Saturdays of every month and signing in the station register until further orders. Subsequently, the prosecution filed Crl.M.P. No.18 of 2024 seeking cancellation of anticipatory bail on the ground that the petitioner failed to comply with the conditions imposed by the Court. It is stated that the petitioner did not attend before the Station House Officer as directed and did not file any counter in the cancellation petition. By order dated 18.04.2024, the learned Principal Sessions Judge allowed the petition and cancelled the anticipatory bail granted to the petitioner. 4. Heard Sri A. Venkata Durga Rao, learned counsel for the petitioner, and the learned Assistant Public Prosecutor for the State. 4 5. Learned counsel for the petitioner submits that the cancellation was not on merits but solely on the ground of alleged non-compliance with appearance conditions. He would further submit that the petitioner, being a daily-wage worker, had gone to Ballari, Karnataka, for livelihood and could not attend the police station due to financial constraints. He also further submit that no notice of the cancellation petition was served upon the petitioner and that the order was passed in violation of principles of natural justice. The petitioner asserts that he has no criminal antecedents and is willing to comply with any conditions imposed by this Court. 6. The learned Assistant Public Prosecutor submits that the petitioner violated the conditions of anticipatory bail and that the cancellation order was rightly passed. It is further submitted that the petitioner failed to appear before the Sessions Court and did not offer any explanation at the relevant time. 7. This Court has perused the material available on record. The anticipatory bail granted to the petitioner was subject to specific conditions. It is evident from the record that the petitioner did not comply with the condition requiring periodical attendance before the Station House Officer. The order of cancellation indicates that despite opportunity, the petitioner did not file any counter nor assign reasons before the Sessions Court. 5 8. Insofar as the present revision is concerned, the petitioner has filed I.A. No.1 of 2025 seeking condonation of delay of 561 days in filing the Criminal Revision Case. Except stating that he came to know about the cancellation order in December, 2025 and thereafter approached counsel, no satisfactory material has been placed before this Court explaining the inordinate delay. The explanation offered does not constitute sufficient cause within the meaning of law for condoning such a long delay. 9. In the absence of convincing and cogent reasons for condoning the delay, this Court is not inclined to exercise its discretionary jurisdiction under Sections 438 and 442 BNSS to interfere with the order of cancellation passed by the learned Principal Sessions Judge, Guntur. 10. Accordingly, I.A. No.1 of 2025 is dismissed. Consequently, the Criminal Revision Case is also dismissed. 11. As a sequel thereto, miscellaneous petitions, if any pending, shall stand closed. Consequently, miscellaneous applications, if any pending, shall stand closed. __________________________________________ DR. JUSTICE VENKATA JYOTHIRMAI PRATAPA Date: 12.02.2026.
