3 HBKM,J W.P.No.3046 of 2026
The Court made the following Order:
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue appearing for the respondent Nos.1 to 5. 2.
The issuance of notices to the respondent Nos.6 to 15 is dispensed with as no prejudice would cause to them, even if it is disposed of in their absence. 3. This writ petition is filed questioning the notice of the 5th respondent dated 30.01.2026 calling the parties concerned including the petitioner and the unofficial respondents for enquiry pursuant to the complaints received dated 05.01.2026 from the unofficial respondents herein. 4. The learned counsel for the petitioner submits that the 5th respondent cannot go into the title aspect of the subject upon complaint given by the unofficial respondents. The said authority suffers from inherent lack of jurisdiction to go into the aspect of title of the subject land. 5. On the other hand, the learned Assistant Government Pleader relying upon the written instructions of the 5th respondent dated 02.02.2026 submits that the issuance of notice is an essential and mandatory procedural requirement prior to conducting of any enquiry, as it ensures compliance with the principles of natural justice by affording an opportunity to all the concerned parties to participate in the enquiry and place their version on record. The notice in question is only an initiation of enquiry proceedings and does not determine or adjudicate any rights, title or interests of any party. 4 HBKM,J W.P.No.3046 of 2026
6. In view of the submissions made, recording the said instructions of the 5th respondent dated 02.02.2026, the petitioner is permitted to submit his explanation enclosing all the necessary documents in support of his claim to the 5th respondent pursuant to the above said notice dated 30.01.2026 within a period of four (04) weeks from the date of receipt of this order.
On receipt of such explanation from the petitioner, the 5th respondent shall proceed with the necessary enquiry, pursuant to the above said notice dated 30.01.2026 strictly in accordance with law, by hearing all the parties concerned including the petitioner and the unofficial respondent Nos.6 to 15 and others if any, upon verification of the records and the subject land, appropriate decision shall be taken on its own merits as expeditiously as possible, preferably within a period of three (03) months thereafter. The written instructions of the 5th respondent dated 02.02.2026 shall be made as part of the Court record. 7. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs. As a sequel, Interlocutory Applications pending, if any, shall stand closed. __________________________ JUSTICE B. KRISHNA MOHAN
