Petitioner has preferred this writ petition (civil) under Article 226 of the Constitution of India, seeking following reliefs :- 10.1 Το direct the respondent authorities to ascertain/evaluate and re-examine the total value of compensation with respect to subject land admeasuring 83.14 sq. meter area in accordance with Right to Fair Digitally signed by AVANISH KUMAR PATHAK Date: 2026.02.03 13:21:31 +0530 2 Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and deposit the compensation amount with 12% interest after adjusting the amount already being paid to the petitioner with respect to the subject land. 10.2 That, without prejudice to the aforesaid prayer sought in the relief, in alternative, this Hon'ble Court may kindly be pleased to direct the respondent authorities to re-ascertain/re-asses/re-examine and calculate the total compensation amount to be paid to the petitioner in accordance with market purchase value guidelines issued for the urban land for the year 2018- 19 (5020/-Rs. per sq. meter) or 2014-15 (4200/- Rs. per sq. meter) in accordance with law and deposit the total amount of compensation including the revised solatium with 12% rate of interest from the date of acquisition till the date of deposit, in the interest of justice. 10.3 That, this Hon'ble court may kindly be pleased to award higher rate of interest of compensation from the date of acquisition till the final date of payment determined by this Hon’ble Court upon final adjudication of the merits of the case. 10.4 Any other relief deemed fit in the facts and circumstances of the case may also be granted. 2. Learned counsel for the petitioner submits that, some portion of the residential house of the petitioner was demolished by the respondent 3 No. 4/Nagar Palika, Khairagarh, Distt. Rajnandgaon (now Khairagarh- Chhuikhadan-Gandai) in the year 2014, but compensation was paid to the petitioner on 5-9-2022 on the basis of guidelines of 2019-2020, whereas the guidelines of 2014-2015 or 2018-2019 ought to have been applied. 3. In reply, learned counsel appearing for the State submits that, WPC No. 2771/2018 and other connected matters involving similar issue of same district Rajnandgaon (now Khairagarh-Chhuikhadan-Gandai) has been decided by the Coordinate bench of this Court vide order dated 8-10-2018. He further submits that, if the petitioner files a representation before respondent No. 3/Collector, Distt. Rajnandgaon (now Khairagarh-Chhuikhadan-Gandai) for redressal of his grievance, then the same shall be considered and decided in terms of the order dated 8-10-2018 passed by the Coordinate bench in WPC No. 2771/2018 and other connected matters. 4. At this stage, learned counsel for the petitioner submits that, in view of above submission of the State counsel, he may be permitted to withdraw this writ petition with liberty to file a representation before the respondent No. 3/Collector, Distt. Rajnandgaon (now Khairagarh- Chhuikhadan-Gandai) raising his grievance as has been raised in this petition. 5. Since similar issue pertaining to Distt. Rajnandgaon (now Khairagarh- Chhuikhadan-Gandai) has already been decided by the Coordinate bench of this court vide order dated 8-10-2018 passed in WPC No. 2771/2018 and other connected matters, therefore, in view of above submissions, learned counsel for the petitioner is permitted to 4 withdraw this writ petition with liberty to file a representation along with a copy of this order before respondent No. 3/Collector Distt. Rajnandgaon (now Khairagarh-Chhuikhadan-Gandai) within a period of 15 days from today, for redressal of his grievance as has been raised in this petition, and if petitioner files such representation, then the Collector, Distt. Khairagarh-Chhuikhadan-Gandai shall decide the same in terms of Order dated 8-10-2018 passed by this Court in WPC No. 2771/2018 and other connected matters within 45 days from the date of filing of the representation. 6. With the above observations and directions, this writ petition is disposed of as withdrawn. 7. Interlocutory application(s), if any, stands disposed of. No order as to costs.
