Page 4 of 5 3. Today, when the matter is taken up, learned standing counsel for Housing Board submitted the instructions of the District Head Housing (FAC), West Godavari District, Bhimavaram, wherein it is stated as follows: “Accordingly, issued revised guidelines through circular No.624/APSHCL/E&P/Critical Infra/2024/General/Court cases Dt.11-09-2025 of the Managing Director, AP State Housing Corporation Ltd. i.e., obtaining the proposals from the executing department by the DHH-West Godavari District, inspection of work by DHHs, sending proposals from District Collector, sending proposals by the housing Department to the Finance Department, release of BRO by the Finance Department, allocation of budget to the executing department and uploading of bills in NIDHI portal by the executing department and clearance of bill by the Finance Department.  The fund proposals were submitted to the Managing Director, APSHCL, on 23-10-2025.  The Managing Director, APSHCL, forwarded the budget proposals to the Government on 20-01- 2026.  However, the budget has not yet been allocated by the Finance Department.” 4. The instructions would disclose that the petitioner has executed the aforementioned work for a total value of Rs.5,14,939/- and the net amount payable to the petitioner after standard deductions of Rs.67,329/-, is Rs.5,77,524/-. The written instructions are made as part of the record. Page 5 of 5 5. Learned counsel for the petitioner endorses the same. The learned counsel for the petitioner paid the deficit Court Fee of Rs.100/- and filed a memo along with e-Pay Receipt, vide USR No.35734/26. 6. Thus, as seen from the instructions, there is no dispute regarding the execution of works and the petitioner‟s entitlement for Rs.5,77,524/-. Since the amount payable is admitted and undisputed, the writ petition is maintainable. In M/s Utkal Highways Engineers and Contractors v. Chief General Manager & Ors1, it was held at Para No.8 as under: “Be that as it may, the High court has not dealt with the merits of the writ petition. Moreover, it is not an inviolable rule that no money claim can be adjudicated upon in exercise of writ jurisdiction. Non-payment of admitted dues, inter alia, may be considered an arbitrary action on the part of respondents and for claiming the same, a writ petition may lie. Further, throwing a writ petition on ground of availability of alternative remedy after 10 years, particularly, when parties have exchanged their affidavits, is not the correct course unless there are disputed questions of fact which by their very nature cannot be adjudicated upon without recording formal evidence.” 7. Given the instructions furnished by the District Head Housing (FAC) West Godavari District, Bhimavaram, the Writ Petition is disposed of directing the respondents to release the amount of Rs.5,77,524/- (Rupees Five Lakhs Seventy Seven Thousand Five Hundred and Twenty Four only) payable to the petitioner regarding execution of aforementioned work, within two (02) months from the date of receipt of the copy of this order. No order as to costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed. ___________________________ JUSTICE SUBBA REDDY SATTI Date: 23.03.2026 IKN/JLSR 1 2025 SCC online SC 1400
