This is an application filed under Section 483 of the BNSS, 2023 by the petitioner, namely, Samsuddin Ali, for releasing on bail in connection with NDPS Case No. 03/2023 arising out of Mukalmua P.S. Case No. 307/2022, pending in the court of the learned Special Judge, Nalbari. At the time of trial of the case, the petitioner was in judicial custody in respect of Special NDPS Case No. 32/2024, pending in the court of the learned Special Judge, Barpeta and, therefore, he was produced in the Page No.# 2/2 court at Nalbari from jail. It may be mentioned herein that in the case before the court of the learned Special Judge, Nalbari, the petitioner was granted bail by this court on 18.01.2023 in Bail Application No. 3532/2022. Subsequently, petitioner was acquitted from the case at Barpeta but he still remained in judicial custody. He prayed before the court at Nalbari for releasing him on bail but the learned court at Nalbari refused to grant his bail application. I have considered the submission made by the learned counsel for both sides. Without any elaborate discussion in this matter, it is hereby directed that the petitioner Samsuddin Ali, who is facing trial in NDPS Case No. 03/2023 arising out of Mukalmua P.S. Case No. 307/2022 pending in the court of the learned Special Judge, Nalbari is allowed to go on bail of Rs. 25,000/- with one surety of like amount to the satisfaction of the learned Special Judge, Nalbari. Petitioner is directed to attend the trial court regularly and if he fails to do so, the trial court shall have the liberty to procure the attendance of the petitioner in accordance with law.
