This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending her arrest in connection with Crime No.04/2026 registered at Police Station – Devendra Nagar, GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.01.27 11:10:15 +0530 2 District Raipur, Chhattisgarh for the offence punishable under Sections 318(4) & 3(5) of B.N.S., 2023. 2. Case of the prosecution, in brief, is that the FIR has been lodged at the behest on one Mr. Nemichand Jain (complainant) who has alleged that the Applicant along with other co-accused, had defrauded him of Rs. 2,00,00,000/- (Rupees Two Crores only) by providing an inducement of Rs. 40,00,000/- (Rupees Forty Lakhs only) as interest along with the alleged amount within a few days. It is alleged that the complainant had on suggestion from one of the co-accused persons, initially invested an amount of Rs. 1,00,000/- (Rupees One Lakh only) after receiving information on a Telegram group and thereafter received a total amount of Rs. 1,30,000/- (Rupees One Lakh Thirty Thousand only) in the month of November 2025. It is further alleged that the applicant, along with other co-accused, had induced the complainant to invest an amount of Rs. 2,00,00,000/- (Rupees Two Crores only) in the shares of the Tata Consultancy Services company, and the said amount was paid to them in cash. 3. Learned counsel for the applicant submitted that the applicant is a Principal of college and she has also been bestowed with excellence award in the academic line. It is further stated that the applicant had joined one Telegram group and at the instance of the applicant, the complainant parted some money to the co- accused Sumit Nanda, Vikas Sahu, Ajay Tripathi and Ajit Patra 3 who have deceived the complainant of a huge amount that if complainant gives Rs.2 crores, he would be getting benefit of Rs.40 lakhs. It is stated that no recovery of any amount has been made from the applicant. He would further submit that applicant being a lady, she is ready to abide by all the directions and conditions, which may be imposed by this Court while granting the bail and the applicant is a permanent resident of the above- mentioned address mentioned in the cause title, therefore, there is no likelihood of her absconding, therefore, he submits that the present applicant is entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel, appearing for the non - applicant/State, opposes the prayer for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts & circumstances of the case, submission of learned counsel for the parties, materials available on record, considering the nature of allegation levelled against the applicant, further the fact that applicant being a lady and case of the applicant is distinguishable from the case of the other co-accused persons, without commenting anything on the merits of the case, I am inclined to grant anticipatory bail to the present applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Archana Agrawal, on executing a personal bond and one surety in the like sum to the 4 satisfaction of the arresting Officer, she shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant shall appear before the trial Court on each and every date given to her by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of their adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. (e) The applicant shall not involve herself in any offence of similar nature in future. Sd/- (Ramesh Sinha) Chief Justice gouri
