The petitioner is apprehending his arrest in connection with Dhanbad P.S. Case No.84 of 2026, for the alleged offences registered under Sections 115(2), 126(2), 109(1) and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned Chief Judicial Magistrate, Dhanbad. 3. Learned counsel appearing for the petitioner submits that the petitioner and informant’s side are relative and the altercation took place on the day of Holi festival. He further submits that allegations are there of stabbing by knife, however, there is no injury of knife. He then submits that the petitioner has got no criminal antecedent as disclosed in paragraph No.11 of the petition. 4. Learned counsel appearing for the State opposed the prayer 2026:JHHC:16707 --2-- A.B.A. No. 2973 of 2026 and submits that allegation of assault is there against the petitioner as well as grievous injury has been received. 5. Looking into the contents of FIR it transpires that allegations are there against three persons of assault and it is not clear pursuant to whose assault injury has been received and the petitioner and informant’s sides are relative and the petitioner has got no criminal antecedent as disclosed in paragraph No.11 of the petition, I am inclined to provide anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Dhanbad in connection with Dhanbad P.S.
