The Court made the following Order: (per Hon’ble Sri Justice R. Raghunandan Rao)
The assessment of the petitioner, for the assessment year, 2019-2020, under the Income Tax Act, 1961 (herein referred to as ‘the Act), had been initiated, by way of a notice, dated 26.03.2023 under Section 148A(d) of the Act and the second notice, under Section 148 of the Act, dated 27.03.2023. These proceedings were culminated in an order of assessment, dated 20.03.2024, conducted by the Jurisdictional Assessing Officer. The show-cause notice, under Section 148A(d) of the Act and the second notice, under Section 148 of the Act, were issued by the Jurisdictional Assessing Officer, while the assessment completed under the faceless system. 2. The petitioner being aggrieved by these proceedings, had initially filed an Appeal before the Appellate Authority, which came to be withdrawn by the petitioner. 3. The petitioner, after withdrawing the Appeal, has approached this Court, by way of the present Writ Petition. 4. The contention of the petitioner is that, the order of assessment, dated 20.03.2024, is without jurisdiction in as much as the proceedings, under which the said assessment order had been passed, had been initiated by issuance of notices, by the Jurisdictional Assessing Officer and the same is violative of Section 151A of the Act. 4
RRR,J & TCDS,J W.P.No.2926 of 2026
5. A Division Bench of this Court in the case of Prameela Pasumarthi Vs. CIT1 and following the judgments of various other Hon’ble High Courts, had held that, any assessment initiated by issuance of notices, by the Jurisdictional Assessing Authority, would be violative of the mandatory provisions of Section 151A of the Act, in as much as the said provision mandates that all such assessments should only be initiated and completed through the faceless systems. 6. Following the said judgment, this Writ Petition is allowed, setting aside the notice, dated 27.03.2023, issued by the 1st respondent and all consequential proceedings. However, it shall be open to the respondent authorities to initiate and complete assessment, in accordance with Law. There shall be no order as to costs. As a sequel, pending miscellaneous applications, if any, shall stand closed.
