This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.525/2025 registered at Police Station – Balco, District Korba (C.G.) for the offence punishable under Section 310 (2) of Bharatiya Nyaya Sanhita, 2023. Case of the prosecution, in brief, is that the FIR was lodged by the complainant Chandra Bhawan Yadav alleging inter-alia that on 16-08-2025, he was coming towards Polytechnic College Rumgara along with his friend i.e. Sarvan Singh and Dilbodh Yadav and at about 11.40 PM, three persons came from the motorcycle along with 6-7 persons. It is alleged that they assaulted to the complainant and his friend and looted amount of Rs.5,700/- and mobile phone. On the basis of report lodged by the complainant, the police registered the offence against Deepak Maravi and 6-7 other persons. During the course investigation, the memorandum statement of co-accused persons were recorded, in which they have stated that along with them the present applicant is also involved. 3. It is argued by learned counsel for the applicant that the name of the applicant has come into light in the memorandum statement of the co-accused Deepak Maravi who has already been allowed bail by this Court in MCRC No.9765/2025 on 04/12/2025. It is stated that the applicant was admitted in the hospital on the date and time of the incident and he has annexed the copy of his medical documents and further he was discharged and thereafter again admitted for surgery, the said fact has not been disputed by the learned State counsel. He would submit that the applicant is ready to abide by all the directions and conditions which may be imposed by this Court while granting bail, the applicant is permanent resident of above mentioned address shown in the 3 cause title and there is no likelihood of his absconding or tampering with prosecution witnesses, therefore he prays to enlarge the applicant on anticipatory bail. 4. On the other hand, learned State counsel, appearing for the non - applicant/State, opposes the prayer for grant of anticipatory bail. She would submit that the applicant has no criminal antecedents. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts & circumstances of the case, submission of learned counsel for the parties, materials available on record, further the fact that the name of the applicant has come into light in the memorandum statement of the co-accused Deepak Maravi who has already been allowed bail by this Court in MCRC No.9765/2025 on 04/12/2025, further considering the fact that the applicant was admitted in the hospital on the date and time of the incident and he has annexed the copy of his medical documents and further he was discharged and thereafter again admitted for surgery, the said fact has not been disputed by the learned State counsel and also considering the fact that the applicant has no criminal antecedents, therefore, I am inclined to grant anticipatory bail to the present applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Ramkumar Sahu, on executing a personal bond and one surety in the like sum to the 4 satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
