The petitioner has moved this Court for grant of bail in connection with Koderma P.S. Case No.95 of 2025 registered for the offences punishable under sections 126(2)/ 115(2)/ 308(2)/ 308(5)/ 351(2)/352/3(5) of the B.N.S., 2023. Learned counsel for the petitioner files the supplementary affidavit. Keep the same in the record. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner has committed extortion by stopping the vehicles with the help of sticks and used to collect Rs.100/-, Rs.200/- and Rs.500/- from the drivers of each of the vehicles passing through Dibour Valley. It is further submitted that the allegations against the petitioner are all false and collection of fee/tax was duly allotted to the petitioner and he was authorized to collect bus tax for the period 16.05.2025 to 15.04.2026 as per the work order issued by the District Development Commissioner-cum-Chief Executive Officer, Zila Parishad , Koderma and in this respect, the learned counsel for the petitioner draws the attention of this Court to Annexure-5 of the bail application. It is further submitted that on 15.05.2025 an agreement of settlement of Mehatari Bust stand was entered into between the petitioner and Executive Officer, Zilaparishad, Koderma and in pursuance of the said public auction, the petitioner appointed daily wage labourers and staff to assist in the collection of tax from commercial vehicles entering or using the Meghatari Bus stand. It is then submitted that the petitioner has been in custody since 06.05.2026, as has been mentioned in paragraph no. 27 of the bail application. It is next submitted that the petitioner undertakes to cooperate with the trial of the case and further undertakes that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case. Hence, it is submitted that the petitioner be admitted to bail. The learned Spl. P.P. opposes the prayer for bail. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the abovenamed petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Koderma, in connection with Koderma P.S.
